A Form E Certificate Is Not a Guarantee of Origin

1. The claim

A buyer receives certified documents, believes the origin question is settled, and later discovers the goods do not qualify for the preferential rate claimed.

2. Why a certificate is not a guarantee

The certificate records a declaration of origin.

Whether that declaration was right depends on facts the certifying authority does not verify: the composition of the materials, the process, the cost structure.

3. What is verified at issuance

The application form, the supporting documents and the consistency between them.

4. What is verified at the destination

The importing authority may accept the certificate at face value and grant the preference.

It may also, alone or on a risk basis, request verification from the issuing authority.

5. What verification examines

The bill of materials and the HS codes of the components.

The product-specific rule and whether the goods meet it.

Cost records, where a value-content rule applies.

The production records.

6. The result of a failed verification

Withdrawal of the preference.

Duty recovery from the importer.

In many agreements, the importer’s duty recovery is passed back to the exporter contractually.

7. The scenario

An exporter claimed preferential origin on the basis that the final processing occurred in China.

The product-specific rule required a heading change that the imported components did not achieve.

The preference was withdrawn three years later, and the recovery was substantial because it covered the accumulated volume.

8. What reduces the exposure

Test every product against the actual rule once, and record the test.

Keep supplier declarations for imported materials.

Keep the cost breakdown, even where the rule is a tariff change rather than a value test.

Retest after any change in sourcing or process.

9. Closing view

The certificate is a claim. The file behind it is what makes the claim defensible.
