China’s export licensing regime covers specific goods, not all exports.
The main categories:
Dual-use items
Goods, software and technology that have both civilian and military applications, or that could contribute to weapons of mass destruction.
Controlled under the Export Control Law and the dual-use item export control regulations.
Licensed by the Ministry of Commerce.
Military items
Arms, ammunition and military equipment.
Controlled by the equipment development department and the Ministry of Commerce, with defence authorities.
Nuclear items
Nuclear materials and related technology, controlled by the nuclear export control regulations.
Controlled chemicals
Precursor chemicals and certain industrial chemicals.
Endangered species products
Anything derived from species listed under CITES requires a permit.
Strategic materials
Certain minerals and metals, with controls that have been adjusted over recent years.
2. The general rule
Most manufactured goods and consumer products are not licensed. They are subject to ordinary customs declaration.
The licensing regime catches specific categories, and the determination is product-specific.
3. The HS code as the first sift
The export control classification begins with the HS code, but does not end there.
A product may fall under a chapter where some goods are controlled and others are not.
Dual-use controls operate on specific technical parameters, and the HS code alone does not determine whether a product is controlled.
Where a product’s HS code appears on a control list, the technical parameters determine whether the specific item is caught.
4. The parameter test
The dual-use control lists specify technical thresholds.
For certain machine tools, the threshold is precision. For certain chemicals, the threshold is concentration or purity. For certain electronics, the threshold is performance.
A product family may include items below and above the threshold.
This is why exporters in controlled sectors need technical assessment rather than HS classification alone.
5. The consequence of misclassifying
Exporting a controlled item without a licence is a criminal matter under the Export Control Law.
Penalties include fines, confiscation and, for serious cases, criminal liability for the responsible persons.
Beyond the legal exposure, the exporter faces customs enforcement, which includes inspection and entry into customs credit rating systems.
6. The evaluation route
Where a product might be controlled, the exporter can apply to the competent authority for a classification opinion, or consult the published control lists and technical parameters.
The authority does not pre-classify every product, but the published lists are sufficiently specific for the determination in most cases.
7. Common errors
Assuming the HS code settles it
Dual-use controls operate on technical parameters.
Assuming a product is uncontrolled because it is ordinary commercial goods
Some widely traded industrial products are controlled at specific specifications.
Not checking for CITES
Products with plant or animal content may need permits.
Treating a licence as a formality
Unlicensed export of controlled goods is a criminal matter.
8. Closing view
The licensing regime is narrow and deep: it covers a small share of China’s export volume, and where it applies, the analysis is technical.
For exporters in ordinary consumer and industrial goods, the answer is usually that no licence is required. For exporters in electronics, machinery, chemicals and materials, the analysis deserves care.
