Amending or Revoking a China Export License

1. Two different actions

Amending a licence: changing a detail on a valid licence.

Revoking a licence: cancelling it.

They have different grounds and different consequences.

2. The amendment

Grounds for amendment:

Quantity adjustment within the licensed scope.

Shipment schedule change.

Correction of a clerical error.

Change of consignee within the same end-user group, where the authority permits.

What cannot be amended: the goods, the end user, the destination, the licence type.

Where any of those changes, a new licence is required.

3. The revocation

Grounds for revocation:

The transaction has been cancelled.

The end user or end use has changed such that the licence no longer describes it.

The exporter has discovered that the goods will be used for a prohibited purpose.

The authority has determined that the licence should not have been issued.

4. The exporter’s obligation to report

Where the exporter becomes aware that the end use or end user has changed, or that the goods may be diverted, the obligation is to report to the authority.

That report may lead to amendment or revocation.

Failing to report is itself a violation.

5. The consequences of revocation

The licence is void. Any declaration referencing it cannot be released.

Goods already exported under the licence are not retroactively affected, but the export is subject to review.

Where the revocation followed diversion or misuse, the review may become enforcement.

6. The unused balance

Where a licence is revoked with quantity unused, the balance is lost.

Where a licence is amended downward, the released quantity is available to the authority.

7. The practical sequence

Where a change is needed:

Determine whether it is within amendment scope or requires a new licence.

Apply through the licensing system.

Do not ship against a licence that no longer describes the transaction.

Where the shipment has already been declared, coordinate with the customs broker before the licence changes.

8. Common errors

Shipping against an amended-scope change without amending

The declaration does not match the licence.

Treating a change of end user as an amendment

Not amendable.

Not reporting a known change in end use

A violation in itself.

Declaring before the amendment is issued

The declaration is verified against the licence as it stands.

9. The record

Both amendments and revocations are recorded against the exporter.

An exporter with a pattern of revocations faces closer scrutiny on subsequent applications.

This is a reason to get the application right first rather than to treat amendment as routine.

10. Closing view

Amendment and revocation are the mechanism for keeping licences accurate, and they are also a record of how well the exporter manages the regime.

Using them as intended is fine. Using them because the original application was careless is a different matter.
