Will Notarization Apostille for Overseas Property Purchase in the United States

The Situation

A buyer in Shenzhen came to us after a previous agent had withdrawn from the case, preparing an overseas purchase completion for property transfer in the United States.

The will notarization had been notarized and apostilled. It was then examined by the land registry, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the will must be executed in person before the notary, and a proxy-drafted or subsequently signed will cannot be notarized.

What Actually Went Wrong

US receiving bodies read the notarization text itself rather than trusting the seal.

In this case the gap was narrower: the will must be executed in person before the notary, and a proxy-drafted or subsequently signed will cannot be notarized. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.

US institutions reject notarizations that certify "copy consistent with original".

How It Was Resolved

The fix ran through the notary-witnessed record of the will execution rather than through the Apostille stage. Once that record was in hand, the notarization could certify the assets disposed of must match the ownership records, and foreign assets need confirmation the receiving state recognises the will, and the Apostille attached to it meant something.

The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because property transfer can absorb some delay, the recovery fit inside the original schedule.

The General Rule

Three things decide whether a will notarization clears property transfer in the United States:

One, the will must be executed in person before the notary, and a proxy-drafted or subsequently signed will cannot be notarized.

Two, the assets disposed of must match the ownership records, and foreign assets need confirmation the receiving state recognises the will.

Three, US academic deadlines are hard and non-negotiable.

The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
