Name Change Notarization Apostille for Skilled Migration in the United States
The Situation
A software developer in Hangzhou came to us after a previous agent had withdrawn from the case, preparing a points-based application for residence permit application in the United States.
The name change notarization had been notarized and apostilled. It was then examined by the immigration authority, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the former name must be traceable to a change record in the household archive, and old changes with incomplete archives cannot be traced.
What Actually Went Wrong
US receiving bodies read the notarization text itself rather than trusting the seal.
In this case the gap was narrower: the former name must be traceable to a change record in the household archive, and old changes with incomplete archives cannot be traced. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.
US institutions reject notarizations that certify "copy consistent with original".
How It Was Resolved
The fix ran through the police household archive name change record rather than through the Apostille stage. Once that record was in hand, the notarization could certify the old and new names must clearly identify the same person, and the Apostille attached to it meant something.
The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because residence permit application runs on a fixed deadline, that recovery time came out of the client's own buffer rather than extending the deadline.
The General Rule
Three things decide whether a name change notarization clears residence permit application in the United States:
One, the former name must be traceable to a change record in the household archive, and old changes with incomplete archives cannot be traced.
Two, the old and new names must clearly identify the same person.
Three, US academic deadlines are hard and non-negotiable.
The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
Check These Before You Submit
- Confirm what the immigration authority in the United States requires, in writing, before notarizing
- Check that the notarization certifies the fact — the former name must be traceable to a change record in the household archive, and old changes with incomplete archives cannot be traced
- Verify the old and new names must clearly identify the same person
- Have the police household archive name change record ready before the notary appointment
Legal Basis
