Birth Certificate Apostille for Family Reunion in the United States
The Situation
A husband in Shenyang came to us after a previous agent had withdrawn from the case, preparing a family sponsorship file for family reunion application in the United States.
The birth certificate had been notarized and apostilled. It was then examined by the immigration authority, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the notarization must certify the birth fact and parentage, not merely that a copy matches the original.
What Actually Went Wrong
US receiving bodies read the notarization text itself rather than trusting the seal.
In this case the gap was narrower: the notarization must certify the birth fact and parentage, not merely that a copy matches the original. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.
US institutions reject notarizations that certify "copy consistent with original".
How It Was Resolved
The fix ran through the hospital birth record or the household register birth entry rather than through the Apostille stage. Once that record was in hand, the notarization could certify the parents' names must match the household register exactly and the birth date character for character, and the Apostille attached to it meant something.
The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because family reunion application runs on a fixed deadline, that recovery time came out of the client's own buffer rather than extending the deadline.
The General Rule
Three things decide whether a birth certificate clears family reunion application in the United States:
One, the notarization must certify the birth fact and parentage, not merely that a copy matches the original.
Two, the parents' names must match the household register exactly and the birth date character for character.
Three, US academic deadlines are hard and non-negotiable.
The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
Check These Before You Submit
- Confirm what the immigration authority in the United States requires, in writing, before notarizing
- Check that the notarization certifies the fact — the notarization must certify the birth fact and parentage, not merely that a copy matches the original
- Verify the parents' names must match the household register exactly and the birth date character for character
- Have the hospital birth record or the household register birth entry ready before the notary appointment
