Will Notarization Apostille for Overseas Property Purchase in the United Kingdom
The Situation
An investor from Shanghai came to us with the intake deadline three weeks out, preparing a property transfer file for property transfer in the United Kingdom.
The will notarization had been notarized and apostilled. It was then examined by the land registry, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the will must be executed in person before the notary, and a proxy-drafted or subsequently signed will cannot be notarized.
What Actually Went Wrong
UKVI applies a document-format checklist and rejects anything that does not match it.
In this case the gap was narrower: the will must be executed in person before the notary, and a proxy-drafted or subsequently signed will cannot be notarized. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.
UKVI is strict about the issuing authority being named on the Apostille.
How It Was Resolved
The fix ran through the notary-witnessed record of the will execution rather than through the Apostille stage. Once that record was in hand, the notarization could certify the assets disposed of must match the ownership records, and foreign assets need confirmation the receiving state recognises the will, and the Apostille attached to it meant something.
The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because property transfer can absorb some delay, the recovery fit inside the original schedule.
The General Rule
Three things decide whether a will notarization clears property transfer in the United Kingdom:
One, the will must be executed in person before the notary, and a proxy-drafted or subsequently signed will cannot be notarized.
Two, the assets disposed of must match the ownership records, and foreign assets need confirmation the receiving state recognises the will.
Three, UK visa decision windows are short, so documents must be ready before lodging.
The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
Check These Before You Submit
- Confirm what the land registry in the United Kingdom requires, in writing, before notarizing
- Check that the notarization certifies the fact — the will must be executed in person before the notary, and a proxy-drafted or subsequently signed will cannot be notarized
- Verify the assets disposed of must match the ownership records, and foreign assets need confirmation the receiving state recognises the will
- Have the notary-witnessed record of the will execution ready before the notary appointment
