Power of Attorney Apostille for Overseas Engineering in the UAE

The Situation

A port construction firm in Qingdao came to us with eight weeks to the deadline, preparing a project launch package for contract mobilisation in the UAE.

The power of attorney had been notarized and apostilled. It was then examined by the project owner, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact.

What Actually Went Wrong

The UAE requires attestation by its own Ministry of Foreign Affairs even after an Apostille.

In this case the gap was narrower: the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.

The UAE runs a parallel attestation requirement, so an Apostille is not always final.

How It Was Resolved

The fix ran through the notarized signature witnessed by the notary public rather than through the Apostille stage. Once that record was in hand, the notarization could certify the scope of authority must match what the receiving party will actually do, and narrow scopes cause problems later, and the Apostille attached to it meant something.

The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because contract mobilisation can absorb some delay, the recovery fit inside the original schedule.

The General Rule

Three things decide whether a power of attorney clears contract mobilisation in the UAE:

One, the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact.

Two, the scope of authority must match what the receiving party will actually do, and narrow scopes cause problems later.

Three, UAE attestation adds a stage after the Apostille.

The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
