Power of Attorney Apostille for Overseas Property Purchase in Saudi Arabia
The Situation
A buyer from Chengdu came to us with the deadline already inside a month, preparing a land acquisition file for property transfer in Saudi Arabia.
The power of attorney had been notarized and apostilled. It was then examined by the land registry, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact.
What Actually Went Wrong
Saudi Arabia requires legalisation through its own embassy chain plus approved-translator Arabic.
In this case the gap was narrower: the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.
Saudi Arabia requires approved-translator Arabic translation as a condition of legalisation.
How It Was Resolved
The fix ran through the notarized signature witnessed by the notary public rather than through the Apostille stage. Once that record was in hand, the notarization could certify the scope of authority must match what the receiving party will actually do, and narrow scopes cause problems later, and the Apostille attached to it meant something.
The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because property transfer can absorb some delay, the recovery fit inside the original schedule.
The General Rule
Three things decide whether a power of attorney clears property transfer in Saudi Arabia:
One, the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact.
Two, the scope of authority must match what the receiving party will actually do, and narrow scopes cause problems later.
Three, Saudi legalisation is slow and the embassy stage dominates.
The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
Check These Before You Submit
- Confirm what the land registry in Saudi Arabia requires, in writing, before notarizing
- Check that the notarization certifies the fact — the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact
- Verify the scope of authority must match what the receiving party will actually do, and narrow scopes cause problems later
- Have the notarized signature witnessed by the notary public ready before the notary appointment
