Birth Notarization Apostille for Overseas Property Purchase in Romania

The Situation

A buyer from Chengdu came to us with the appointment already booked, preparing a land acquisition file for property transfer in Romania.

The birth notarization had been notarized and apostilled. It was then examined by the land registry, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the notarization must certify the birth fact and parentage rather than copy consistency, which is where most applicants go wrong.

What Actually Went Wrong

Romania accepts the Apostille and requires Romanian translations.

In this case the gap was narrower: the notarization must certify the birth fact and parentage rather than copy consistency, which is where most applicants go wrong. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.

Romania applies a strict validity window, usually three months for civil documents.

How It Was Resolved

The fix ran through the hospital birth record or the original household archive rather than through the Apostille stage. Once that record was in hand, the notarization could certify the parents' names must match the household register exactly, and the Apostille attached to it meant something.

The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because property transfer can absorb some delay, the recovery fit inside the original schedule.

The General Rule

Three things decide whether a birth notarization clears property transfer in Romania:

One, the notarization must certify the birth fact and parentage rather than copy consistency, which is where most applicants go wrong.

Two, the parents' names must match the household register exactly.

Three, Romanian review usually takes three to four weeks.

The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
