Trademark Registration Certificate Apostille for International Trade in Poland
The Situation
A trading company in Yiwu came to us with the intake deadline three weeks out, preparing a shipment documentation set for customs clearance in Poland.
The trademark certificate had been notarized and apostilled. It was then examined by the importing customs authority, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the certificate must reflect the current register state, and any assignment, renewal or change of name since registration makes it stale.
What Actually Went Wrong
Polish authorities require translation by a tłumacz przysięgły sworn in Poland.
In this case the gap was narrower: the certificate must reflect the current register state, and any assignment, renewal or change of name since registration makes it stale. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.
Poland requires sworn translation, and the swearing must be Polish.
How It Was Resolved
The fix ran through the CNIPA trademark register extract rather than through the Apostille stage. Once that record was in hand, the notarization could certify the goods and services classes must match the register exactly, since abbreviated class lists are rejected, and the Apostille attached to it meant something.
The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because customs clearance can absorb some delay, the recovery fit inside the original schedule.
The General Rule
Three things decide whether a trademark certificate clears customs clearance in Poland:
One, the certificate must reflect the current register state, and any assignment, renewal or change of name since registration makes it stale.
Two, the goods and services classes must match the register exactly, since abbreviated class lists are rejected.
Three, Polish work permit processing runs parallel to the document stage.
The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
Check These Before You Submit
- Confirm what the importing customs authority in Poland requires, in writing, before notarizing
- Check that the notarization certifies the fact — the certificate must reflect the current register state, and any assignment, renewal or change of name since registration makes it stale
- Verify the goods and services classes must match the register exactly, since abbreviated class lists are rejected
- Have the CNIPA trademark register extract ready before the notary appointment
