Power of Attorney Apostille for International Bidding in Israel
The Situation
An equipment supplier in Changsha came to us with the intake deadline three weeks out, preparing a bid document set for bid submission in Israel.
The power of attorney had been notarized and apostilled. It was then examined by the tender committee, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact.
What Actually Went Wrong
Israel accepts the Apostille; technical cooperation and engineering are the main use cases.
In this case the gap was narrower: the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.
The Israeli Ministry of Interior reviews notarization wording closely for civil documents.
How It Was Resolved
The fix ran through the notarized signature witnessed by the notary public rather than through the Apostille stage. Once that record was in hand, the notarization could certify the scope of authority must match what the receiving party will actually do, and narrow scopes cause problems later, and the Apostille attached to it meant something.
The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because bid submission runs on a fixed deadline, that recovery time came out of the client's own buffer rather than extending the deadline.
The General Rule
Three things decide whether a power of attorney clears bid submission in Israel:
One, the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact.
Two, the scope of authority must match what the receiving party will actually do, and narrow scopes cause problems later.
Three, Israeli Ministry of Interior review usually takes two to four weeks.
The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
Check These Before You Submit
- Confirm what the tender committee in Israel requires, in writing, before notarizing
- Check that the notarization certifies the fact — the signatory must sign in front of the notary, and a POA signed elsewhere cannot be notarized after the fact
- Verify the scope of authority must match what the receiving party will actually do, and narrow scopes cause problems later
- Have the notarized signature witnessed by the notary public ready before the notary appointment
