Inheritance Notarization Apostille for Opening an Overseas Bank Account in Germany

The Situation

An exporter in Qingdao came to us with the intake deadline three weeks out, preparing a trade account application for account opening in Germany.

The inheritance notarization had been notarized and apostilled. It was then examined by the bank compliance team, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the notarization must list every statutory heir, and omitting one direct relative forces the whole notarization to be redone.

What Actually Went Wrong

German authorities require a certified translation by a translator sworn before a German court.

In this case the gap was narrower: the notarization must list every statutory heir, and omitting one direct relative forces the whole notarization to be redone. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.

Germany rejects translations certified in China but not by a Germany-authorised translator.

How It Was Resolved

The fix ran through identity and kinship proof for every statutory heir rather than through the Apostille stage. Once that record was in hand, the notarization could certify the succession order and shares must follow Chinese law while remaining acceptable abroad, and the Apostille attached to it meant something.

The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because account opening can absorb some delay, the recovery fit inside the original schedule.

The General Rule

Three things decide whether a inheritance notarization clears account opening in Germany:

One, the notarization must list every statutory heir, and omitting one direct relative forces the whole notarization to be redone.

Two, the succession order and shares must follow Chinese law while remaining acceptable abroad.

Three, German appointment slots are the real constraint.

The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
