Death Certificate Apostille for Overseas Property Purchase in France
The Situation
A family in Beijing came to us with the deadline already inside a month, preparing a residential purchase for property transfer in France.
The death certificate had been notarized and apostilled. It was then examined by the land registry, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — a hospital medical death certificate and a police household deregistration serve different purposes and are not interchangeable.
What Actually Went Wrong
French authorities require translation by a traducteur assermenté registered with a French court.
In this case the gap was narrower: a hospital medical death certificate and a police household deregistration serve different purposes and are not interchangeable. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.
France does not accept Chinese-certified translations for civil status documents.
How It Was Resolved
The fix ran through the hospital medical death certificate or the police deregistration record rather than through the Apostille stage. Once that record was in hand, the notarization could certify the date, place and cause of death must be consistent, and the name must match the asset records for inheritance, and the Apostille attached to it meant something.
The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because property transfer can absorb some delay, the recovery fit inside the original schedule.
The General Rule
Three things decide whether a death certificate clears property transfer in France:
One, a hospital medical death certificate and a police household deregistration serve different purposes and are not interchangeable.
Two, the date, place and cause of death must be consistent, and the name must match the asset records for inheritance.
Three, French préfecture appointments are hard to obtain and cannot be moved.
The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
Check These Before You Submit
- Confirm what the land registry in France requires, in writing, before notarizing
- Check that the notarization certifies the fact — a hospital medical death certificate and a police household deregistration serve different purposes and are not interchangeable
- Verify the date, place and cause of death must be consistent, and the name must match the asset records for inheritance
- Have the hospital medical death certificate or the police deregistration record ready before the notary appointment
