Birth Certificate Apostille for Marriage Abroad in France
The Situation
A couple in Chengdu came to us after the first submission had been returned, preparing an overseas wedding registration for marriage registration in France.
The birth certificate had been notarized and apostilled. It was then examined by the local civil registry, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the notarization must certify the birth fact and parentage, not merely that a copy matches the original.
What Actually Went Wrong
French authorities require translation by a traducteur assermenté registered with a French court.
In this case the gap was narrower: the notarization must certify the birth fact and parentage, not merely that a copy matches the original. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.
France does not accept Chinese-certified translations for civil status documents.
How It Was Resolved
The fix ran through the hospital birth record or the household register birth entry rather than through the Apostille stage. Once that record was in hand, the notarization could certify the parents' names must match the household register exactly and the birth date character for character, and the Apostille attached to it meant something.
The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because marriage registration runs on a fixed deadline, that recovery time came out of the client's own buffer rather than extending the deadline.
The General Rule
Three things decide whether a birth certificate clears marriage registration in France:
One, the notarization must certify the birth fact and parentage, not merely that a copy matches the original.
Two, the parents' names must match the household register exactly and the birth date character for character.
Three, French préfecture appointments are hard to obtain and cannot be moved.
The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
Check These Before You Submit
- Confirm what the local civil registry in France requires, in writing, before notarizing
- Check that the notarization certifies the fact — the notarization must certify the birth fact and parentage, not merely that a copy matches the original
- Verify the parents' names must match the household register exactly and the birth date character for character
- Have the hospital birth record or the household register birth entry ready before the notary appointment
