Divorce Certificate Apostille for Skilled Migration in Denmark

The Situation

An accountant from Nanjing came to us with eight weeks to the deadline, preparing a skills assessment set for residence permit application in Denmark.

The divorce certificate had been notarized and apostilled. It was then examined by the immigration authority, and the objection was not about the Apostille seal. It was about what the earlier stage had certified — the divorce must be traceable to either a civil affairs record or a court judgment, and the two routes produce different document sets.

What Actually Went Wrong

Denmark accepts the Apostille and Danish or English translations.

In this case the gap was narrower: the divorce must be traceable to either a civil affairs record or a court judgment, and the two routes produce different document sets. Everything downstream was procedurally correct and substantively useless, because the receiving side needed the fact and had been given the form.

Denmark applies a strict validity window; civil documents over six months usually need reissue.

How It Was Resolved

The fix ran through the civil affairs divorce register or the court judgment plus its effective-date certificate rather than through the Apostille stage. Once that record was in hand, the notarization could certify a court judgment needs the separate certificate that it has taken effect, and the Apostille attached to it meant something.

The redo took five to ten working days at the Apostille stage on top of the time needed to retrieve the record. Because residence permit application runs on a fixed deadline, that recovery time came out of the client's own buffer rather than extending the deadline.

The General Rule

Three things decide whether a divorce certificate clears residence permit application in Denmark:

One, the divorce must be traceable to either a civil affairs record or a court judgment, and the two routes produce different document sets.

Two, a court judgment needs the separate certificate that it has taken effect.

Three, Danish review usually takes two to three weeks.

The Apostille stage itself is the predictable part — five to ten working days, no surprises. The surprises all sit upstream and downstream of it.
