Police Clearance Apostille for a German Work Visa

The Situation

A Shanghai-based engineer accepted a position in Munich in early 2024. His employer's relocation agent sent a checklist that included a police clearance certificate with an Apostille.

He had one already — issued in September 2023, apostilled in October 2023, sitting in a folder because an earlier visa application had fallen through. He sent that one.

The German consulate rejected it in the first week.

What Actually Went Wrong

The Apostille was valid. The police clearance certificate was not, in the consulate's eyes.

Germany applies a three-month window to police clearance certificates for residence permit purposes. The certificate is measured from its date of issue, not from the date the Apostille was attached, and not from the date of submission.

His certificate was seven months old by the time it reached the consulate. Nothing was wrong with the document — it had simply expired for this specific purpose.

How It Was Resolved

We applied for a fresh 无犯罪记录证明 through the local public security bureau — which in Shanghai can be requested online and comes back in two to three working days — then notarized it and sent it for the Apostille.

The timing mattered more than the document work. The Zhejiang and Shanghai Foreign Affairs Offices both run five to seven working days for police clearance apostilles at standard speed. Counting notarization, the total was nine working days from application to the certificate being back in his hands.

The lesson he took was that the clock should start as late as possible — apply for the police certificate no earlier than the point where you can submit it within the validity window.

The General Rule

Police clearance certificates are the one document type where the Apostille date is almost meaningless and the issue date is everything.

Most countries that require them apply a window of three to six months. They differ on whether the window runs from issue, from notarization, or from the Apostille — and some consulates will not tell you until you submit.

The safe working assumption is the shortest window any of the parties involved might apply. If in doubt, get a fresh certificate rather than argue about an old one.

Legal Basis

Hague Apostille Convention; China in force since 7 November 2023. Validity windows are set by the receiving state, not by the Convention.
